TERMS AND CONDITIONS OF SERVICE

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU (“USER,” “YOU”) AND KOINETA (“THE COMPANY,” “WE,” “US,” “OUR”). BY ACCESSING THE WEBSITE, CREATING AN ACCOUNT, OR PURCHASING A MINING PLAN, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY EVERY CLAUSE STATED HEREIN.

1. ACKNOWLEDGMENT OF VIRTUAL ASSETS AND RISK

1.1. No Real-World Currency Guarantee: KOINETA operates as a digital simulation of cloud mining. All "earnings," "profits," and "balances" displayed on the Dashboard are virtual accounting units within the KOINETA ecosystem. They do not constitute legal tender, fiat currency, or guaranteed financial instruments.

1.2. High-Risk Investment Warning: Cryptocurrency markets are speculative and highly volatile. By participating in the KOINETA Presale or purchasing Mining Plans, you acknowledge that you are prepared to lose the entire value of the funds (SOL/KNT) committed to the platform.

1.3. Not a Financial Product: KOINETA is a technology provider, not a bank, broker-dealer, or investment advisor. We do not provide financial advice. All decisions to participate are made solely by the User.

2. ELIGIBILITY AND ACCOUNT GOVERNANCE

2.1. Legal Age: You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is higher.

2.2. Geographic Restrictions: You strictly represent that you are not a citizen or resident of any jurisdiction where the use of cryptocurrency, cloud mining, or token presales is prohibited, restricted, or requires registration (including but not limited to the USA, China, or sanctioned nations).

2.3. Single Account Policy: Users are permitted only one (1) account. The use of multiple accounts to manipulate referral systems or reward structures is strictly prohibited and will result in an immediate permanent ban and forfeiture of all balances.

2.4. Security of Credentials: You are solely responsible for maintaining the confidentiality of your login credentials. KOINETA is not liable for any unauthorized access to your account resulting from your failure to secure your devices or passwords.

3. THE KOINETA (KNT) TOKEN PRESALE

3.1. Finality of Transactions: All Solana (SOL) transmissions to the designated KOINETA deposit address are final. There are no refunds, chargebacks, or reversals under any circumstances.

3.2. Wallet Responsibility: You can send SOL from any wallet you control, including custodial wallets on exchanges (e.g., Binance, Coinbase) or non-custodial wallets (e.g., Phantom, Solflare). It is your responsibility to ensure the transaction is sent correctly. KOINETA is not responsible for funds sent to an incorrect address.

3.3. Token Utility: KNT tokens are "Utility Tokens" designed for use within the KOINETA platform. We make no promise of future listing on exchanges or any specific future market price.

4. MINING SIMULATION AND REWARD STRUCTURE

4.1. Mining Plans: "Buying a Plan" (BTC, DOGE, ETH, KNT Miners) is a purchase of a time-limited digital service. It is not an ownership stake in physical mining hardware.

4.2. Performance Variables: While "Daily Profits" are estimated, the actual distribution of rewards may be subject to network difficulty, platform maintenance, and algorithm updates. KOINETA reserves the right to modify reward rates at any time to ensure the long-term sustainability of the platform.

4.3. Expiration: Once a mining plan reaches its duration (e.g., 20 or 21 days), the service terminates. Any rewards not claimed or withdrawn according to platform rules may be subject to expiration.

5. WITHDRAWALS AND COMMISSIONS

5.1. Withdrawal Thresholds: Withdrawals are subject to minimum amounts and network fees. KOINETA reserves the right to implement "Cooling Periods" where withdrawals are temporarily disabled for security audits.

5.2. Anti-Money Laundering (AML): We reserve the right to request Know Your Customer (KYC) documentation at any time before processing a withdrawal if suspicious activity is detected.

5.3. Referral System: The 20% referral commission is only paid on successful, confirmed purchases by new users. KOINETA reserves the right to audit and revoke referral earnings if fraudulent patterns (e.g., "wash trading") are identified.

6. TECHNICAL LIMITATIONS AND LIABILITIES

6.1. No Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6.2. Platform Downtime: KOINETA is not liable for any losses (perceived or real) resulting from server downtime, maintenance, API failures, or blockchain forks.

6.3. Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOINETA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE USER TO THE COMPANY IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

7. INTELLECTUAL PROPERTY

7.1. Ownership: All content, logos, UI/UX designs, and code (including the KOINETA brand) are the exclusive intellectual property of the Company. Users are granted a limited, non-exclusive license to use the dashboard for personal, non-commercial use only.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless KOINETA and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to the Service or your violation of these Terms.

9. TERMINATION OF SERVICE

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

10. GOVERNING LAW AND ARBITRATION

10.1. Jurisdiction: These Terms shall be governed by the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.

10.2. Dispute Resolution: Any dispute arising from these terms shall be settled through binding arbitration rather than in court. You waive any right to participate in a class-action lawsuit.

11. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and KOINETA. If any provision is found to be unenforceable, the remaining provisions will remain in full effect.
